Introduction:
A trademark protects your brand name, logo, or symbol. It gives you legal rights to use your brand identity and prevents others from copying it. In India, the trademark registration process is managed by the Trademark Registry under the Ministry of Commerce & Industry.
In this blog, we will explain the step-by-step process of trademark registration β from filling the application to getting the final certificate β in simple language
Step 1: Trademark Search
Before filing a trademark application, you should search the Trademark Public Search Database to check whether the desired brand name is already registered or applied for by someone else.

Step 2: Filing of Trademark Application (Form TM-A)
Once the name is available, the application is filed online using Form TM-A. You need to provide the following:
- Brand name/logo
- Applicant details
- Trademark class (based on type of goods/services)
- Power of Attorney (if filed through agent/attorney)
Once filed, you receive an acknowledgement number and the status becomes βSend to Vienna Codificationβ.
Step 3: Examination by Trademark Department
After filing, the examiner checks the application and issues an Examination Report within 30β60 days.
The application can be:
- Accepted for advertisement
- Objected (under Section 9 or Section 11)
Step 4: Reply to Trademark Objection
If your trademark is objected, you need to file a reply within 30 days from the date of the report.
In your reply, you must:
- Justify why your mark is unique
- Attach proof of use (if any)
- Provide legal grounds and citations
If reply is not submitted in time, the application may be abandoned.
Step 5: Hearing (If Required)
If the Registrar is not satisfied with your reply, a Show Cause Hearing is scheduled.
At the hearing:
- You or your attorney present your case
- Additional documents can be submitted
- Registrar may accept or reject the mark
If accepted, it moves to publication.
Step 6: Publication in Trademark Journal
If the application is accepted (either directly or after hearing), it is published in the Trademark Journal for 4 months.
During this time, any third party can file an opposition.
If no opposition is received, the application proceeds to registration.
Step 7: Registration Certificate
If no opposition is filed (or opposition is decided in your favor), you will receive the Trademark Registration Certificate with the official seal.
β The trademark is now valid for 10 years and can be renewed every 10 years.
Conclusion:
Registering your trademark in India protects your business identity and gives you exclusive rights to use your brand name. Though the process may involve objections and hearings, with proper guidance and documentation, you can successfully secure your brand.
